Which of the following most accurately describes the problem?

A MILTON KEYNES driver with nearly three years' experience was told by West Bromwich magistrates that he "should have known better" after he admitted 11 offences of taking insufficient rest.

Ron Lees, prosecuting for Vosa, told the court that on one occasion Colin Davis-Henley had driven for 9hr 43min with only a 26min break. On three other occasions he had driven more than six hours without a rest. The magistrates were told that drivers were required to take a 45min break after driving for 41/2 hours.

The offences were discovered when Davis-Henley was stopped by Vosa for a routine check off the M6 at Birmingham; he was fined £750 with £161 costs.

One of the magistrates told him: "You should have known better — we hope you've learned your lesson," Davis-Henley was driving for APLE of Kiln Harm, Milton Keynes; MD Simon Bright called him one of his 'most genuine" drivers.

III In an unrelated case APLE has been fined £1,000 with £149 costs for overloading a 44-tonner by 272kg. The company admitted the offence and Bright said the transport manager had not done his job properly, but pointed out that this was only APLE's second offence in 10 years.
