Which of the following most accurately describes the problem?

A Telford international haulier who hired Irishregistered vehicles which were not specified on his 0-licence has had his licence revoked. West Midland Traffic Commissioner David Dixon has

also disqualified Mohammed Choudhary, trading as Deans of Telford, from holding an 0-licence for five years.

The TC heard that Choudhary, who held a licence for 10 vehicles and five trailers as a sole trader, had been operating as a limited company, Deans Telford.

He had failed to produce a large number of tachograph charts and those that were seen showed a number of apparent offences (CM18-24 Oct).

The TC pointed out that the practice of running foreignregistered vehicles on a British 0-licence had been ended by a Transport Tribunal decision in February. However, Choudhary could not have been expected to have foreseen that change in policy and he did not take issue with the use of Irish-registered vehicles under the licence.

Reports of a Hungarian driver in a British vehicle and the Jse of green diesel were treated as isolated occurrences.

Making the revocation and disqualification orders, the IC iaid that Choudhary was a director of a company which on us own admission had operated for a long time without an 0icence, pretending that vehicles were running "on the marlin" of the licence.

In the absence of relevant tack charts and hire con.racts, this could not be proved beyond reasonable doubt. But Thoudhary was operating more than the five unspecified /chides covered by the margin for continuous periods well in ixcess of the 28 days allowed.

The whole manner of administration of his road haulage iusiness appears to have been chaotic," said Dixon. "It Is lear that he made untrue statements to the Vehicle nspectorate."
