Which of the following most accurately describes the problem?

• Scarborough haulier Roy Coultas has been granted authority for a change of operating centre but for a reduced number of vehicles and subject to a number of environmental conditions.

He had applied to renew his national licence in respect of four vehicles and two trailers with a move of operating centre to Barker Lane, Snainton. The application was opposed by Scarborough Borough, Council and there was a representation from a local resident.

The Borough Council objected to the use of the access road Barker Lane by Coultas' vehicles, while resident David Pryor complained about the noise and fumes that might arise.

Evidence was given by a vehicle examiner that Coultas, who undertook his own maintenance work, had an unsatisfactory maintenance record.

Granting renewal for two vehicles and one trailer for a four month period only and subject to the production of a satisfactory maintenance contract with an outside agency, North Eastern Licensing Authority Frederick Whalley said he did not consider Coultas capable of undertaking his own maintenance. As far as the access road was concerned the Highways Authority was a higher echelon local authority than the Borough Council and as they had not seen fit to oppose the application he took it that they considered that the access road was suitable. Whalley imposed conditions that, except in an emergency notified to the traffic area, no vehicle is to return to the operating centre after 1800hrs Mondays to Fridays and after 1300hrs on Saturdays.

Furthermore there is to be no maintenance or movement of vehicles on Sundays and no engines are to be started up and run for more than five minutes when a vehicle is in is in the operating centre under normal circumstances.
