I N a case claimed by the defence to be the first of its kind. a North Yorkshire firm of haulage contractors was accused at Stokesly, nr. Middlesbrough, on Wednesday, of operating trailers weighing more than the maximum allowed.

The firm, Arthur Sanderson (Great Broughton) Lid., pleaded not guilty to each of three charges of using •a trailer for hire or reward when not authorized to do so. The .magistrates found the charges proved and imposed a fine of £5 for each offence.

Mr. A. L. Vickers, for the Ministry of Transport, said the firm had licences for eight trailers which stipulated the weight as between 2 tons 4 cwt. and 3 tons 5 cwt. But, he said, when on three different days in July a Ministry of Transport enforcement officer stopped lorries and trailers owned by Sanderson and each carrying a consignment of steel to North Wales, the weights of the trailers were found to be either 4 tons 11 cwt. or 4 tons 13 cwt, For Sanderson, Mr. T: H. CampbellWardlaw said it was a unique case. While admittedly licences issued to the firm mentioned unladen weights as well as types and numbers of trailers, the Northern 1,icensing Authority had in fact no right to lay down unladen weights, he contended, because the Road Traffic Act only mentioned types and numbers. Sanderson will appeal.
