Which of the following most accurately describes the problem?

QI have looked in detail at the EC Regulations governing the use of tachographs and record sheets and cannot find any article that refers to drivers handing in records within 21 days. Is it, in fact, a lawful requirement, or is it just a Ministry guideline? Some of our Continental coach tours go beyond 21 days and it is impossible for the driver to get the charts back.

A Section 97A of the "Pas

senger & Goods Vehicles (Recording Equipment) Regulations 1979" makes it a legal requirement to hand in records within 21 days.

However, in your driver's case, there would be no offence. Article 14 of the EC Regulations 3821/85 specifies that you must issue sufficient number of charts bearing in mind the length of service etc.
