Which of the following most accurately describes the problem?

QOne of our drivers dropped a semi trailer on a lavby to go and get some food. When he came hack he found the police at the scene. Apparently the trailer had rolled back and badly damaged a parked car. The driver thinks some kids let off the park brake because when he pulled it forward, he decoupled and demonstrated to the police that the brake worked. However, they say they are going to prosecute.

struction & Use) Regulations 1986 say in Section 89 — No person in charge of a motor vehicle, or trailer drawn thereby. shall cause or permit such trailer to stand on a road when detached from the drawing vehicle unless at Least one of the wheels of the trailer is prevented from revolving by the setting of the brake or the use of a chain, chock or other efficient device.

If the police are going to try and prosecute the driver for "permitting" as he did not take sufficient action to prevent "kids" releasing the brake — the wording of the summons should be interesting.
