A NEW Certificate of Exemption has been issued under the road tanker regulations by the Health and Safety Executive.
It is intended to clarify one of the two definitions of 'dangerous substance' given in the Dangerous Substances (Conveyance by Road Tankers and Tank Containers) regulations.
The new certificate — Certificate of Exemption 1 of 1986 — replaces and revokes Certificate of ExemPtion no 2 of 1985 which was issued last December.
It exempts from the regulations any substance which is specified as a flammable liquid in Part 1 of the Approved List, but which has a flashpoint above 55 degrees C and is not otherwise a dangerous substance.
The definition under Regulation 2(1), which the change is meant to clarify does not make clear if certain substances are 'dangerous substances'. The certificate will help avoid problems until the HSE finishes new amending regulations.
