HAS a bus operator a legal right to the sole use of a bay at a stoppingplace? This question was argued before Stratford on Avon magistrates last week when a defendant told the court that he had issued a writ relating to such bays to obtain a High Court decision.

"It is my contention that buses have no more right to pull into the kerb there than I have. If there was any obstruction I would not consider myself the cause of it," said Alan Smith, St. Nicklausen, Bishopton Lane, Stratford on Avon, who was charged with obstruction. It was stated that he had left his vehicle between two bus-stop bays, and that buses had to set down passengers some distance from the kerb.

Defending solicitor unsuccessfully applied for an adjournment until after the High Court hearing.

Mr. T. Lowth, town clerk, said that there was no Order authorizing the erection of bus standards, but the corporation retied on certain statutes.

Fining Smith £1 -and ordering him to pay an advocate's fee of £3 3s., the chairman said that the bench was not concerned with the legality or othelwise of the stop, but simply with the case as it stood. An appeal may be lodged.

COUNCIL APPEALS ON BUS CUTS FAIL

TWO local councils in the north have been unsuccessful in appeals against cuts in serilices made by a bus

company. They are the Crook and Willington Urban, and Weardale Rural, District Councils, who appealed against the Northern Licensing Authority's grant of permission to Baldwin and Barlow, Ltd., Tow Law, to withdraw and curtail certain journeys on their stage service between Bishop Auckland and Stanhope. Costs were awarded against the appellants.

The Minister of Transport has also refused, with costs, an appeal by Crosvine Motor Services, Ltd., against the North Western Traffic Commissioners' authorizing of additional journeys on the stage service operated by Mr. C. Wright between Penycae and Wrexham.
