As a result he was now unemployed. An operator could do no more than give drivers clear notice of what would happen if they overloaded. The defendant could demonstrate this had been done, and although it was an absolute offence the magistrates should consider blameworthiness and • give an absolute discharge.

After adjourning the magistrates announced the partners would be fined £45 each, and the driver 00.
