North-Western Deputy Traffic C:o mmi ssioner Mark Hinchliffe told Gregory Shaw, a director of Greggs Discount Foods, that he was "a very lucky man" as he had drawn back from cutting the company's authorisation from two vehicles to one.

Vehicle examiner Michael Bayle said he had carried out a maintenance investigation at the company's Chadderton site in November following the issue of an S-marked prohibition (showing a serious lapse in maintenance) to the company's only vehicle, which did not have a valid test certificate.

The safety inspection records lacked detail and defects reported by drivers were not being repaired quickly enough. The stated inspection period of 12 weeks had been stretched to 20 weeks.Two immediate prohibitions and a variation notice had been issued.

However, the maintenance contractor had been changed following the issue of the S-marked prohibifion. Bayle said the maintenance records produced at the hearing had vastly improved and he felt the company was now on the right track.

Shaw said the vehicle had not been sent in for test while he was out of the country, contrary to his instructions to the firm's original maintenance contractor. He admitted failing to check if it had been tested following his return and agreed to reduce the inspection period to eight weeks. He added that he had not notified the TC of the conviction for using the vehicle without a test certificate as it was a Vosa prosecution and he had thought this was part of the same organisation as the Traffic Area Office.
