It was alleged that in the application form for the supply of motor spirit for agricultural purposes in respect of *four gyro-tillers it was stated that the fuel was to be used for starting and running thd gyro-tillers, the truth being that the machines were operated solely on oil fuel and that 1,000 gallons of motor spirit acquired by the company against the surrender of coupons were used in five motor vehicles for a purpose other than that to which the coupons related, between December 12, 1940, and March 31, 1941, on roads in Stirlingshire and elsewhere in Scotland.
A solicitor for the accused stated that the petrol was required for cars in connection with the ,servicing of the gyro-tillers, which frequently broke down and required spare parts to be taken to them in places where they were operating. Repeated requests were made to get petrol but these were ignored, with the result that the work of the gyro-tillers, with their enormous production capacity, was being crippled. The Agricultural Board was pressing the company to get the _gyrotillers going and to keep them working.'
The sheriff, imposing. a fine of £25, with the alternative of 25 days' imprisonment, said that whilSt he accepted the explanation, it was a serious fault to have applied for the petrol in this manner.
