Which of the following most accurately describes the problem?

THE licence held by K C Williamson & Co has been renewed with a number of environmental conditions by Scottish Licensing Authority Keith Waterworth. The firm was licensed to use either Broathill Farm, Irvington, or The Garage, Hollee, as an operating centre for seven vehicles and eight trailers.

They sought to increase the authorisation to 12 vehicles and 14 trailers, with up to seven vehicles and eight trailers at Broathill Farm and 12 vehicles and 14 trailers at The Garage. A Mr and Mrs John Halliday made representations about the use of the latter. They complained about unacceptable noise levels, particularly on weekend evenings; and general disturbance from on-site lighting and occasional late-night vehicle loading by fork-lift truck.

The LA was told the premises had planning permission for use as a haulage contractor's depot, subject to conditions controlling the use of machinery between 2000 and 0800 hours on weekdays and banning its use at all on Sundays. The nature of the business involved vehicles leaving on a Sunday afternoon, being away all week, and returning Friday afternoon onwards. Undertakings were given tr realign the site lighting and lc instruct drivers not to use noisy machinery after 2000 hours or a all on Sundays.

Waterworth said that he war not persuaded that The Garagr was unsuitable on environmen tal grounds. The site was largr enough to accommodate 1'; vehicles and 14 trailers. Conse quently, he granted renewal a: applied for, but with condition: prohibiting maintenance afte 2000 hours on Fridays, afte 1800 hours on Saturdays an after 1500 hours on Sundays and banning the use of machin ery between 2000 and 0800 or weekdays and at any time or Sundays.
