Which of the following most accurately describes the problem?

• An Edinburgh Corporation bus conductor who sustained head injuries when he was thrown from the platform of a bus as it lurched over potholes in the roadway leading to Longstone bus depot. Edinburgh, was last week awarded £2,500 damages by a jury in the Court of Session.

The Corporation had contested the claim, which was by Thomas Scott Powrie. At the time of the accident he had been conducting a traffic census and was about to hand in his census form at the depot. He blamed the Corporation for failing to maintain the roadway in good condition and to stop buses using it while it was in a bad condition.

According to the Corporation, Powrie stepped off the platform while the bus was moving, lost his footing, and fell at a point where the roadway was in good condition.

Powrie, who sued for £3,500 said that he suffered a fractured skull, causing unsteadiness, emotional instability, dullness of hearing, and blurring of sight.
