AThere is no reason to expect that a driver,

granted an hgv driving licence under the exemption from test arrangements, will have to take a test after February 2, 1973, or at any other time provided he maintains a current hgv driving licence and provided his licence is not revoked for some reason by the Licensing Authority.

If, however, an hgv driving licence is allowed to lapse for a period of more than five years from the date of expiry the driver will have to take, and pass, a test on the appropriate class of vehicle to regain the licence.

In the case of misdemeanours, an LA has powers to revoke an hgv driving licence and also to require a driver to take the test to regain a licence at a later date or he can also, if he feels justified in doing so, require any driver who previously held a licence whether by exemption or by passing the test to take a test.

This can also apply in principle to ordinary driving licence holders. A court can specify that a driver should take a driving test before having a licence returned to him after disqualification.

In both cases, however, it does require a serious offence or series of offences to cause such action to be taken and it does not happen very frequently.
