Which of the following most accurately describes the problem?

A public Inquiry into a Merseyside skip hire firm has been adjourned to allow the company and its transport manager to obtain separate legal representation.

St Helens Skip Hire had been called before the North Western Traffic Commissioner Beverley Bell, who was also considering the repute of its transport manager Fiona Simpson. The directors of the company are Gillian Mark and Patricia Glynn. In July last year, the IC revoked a licence held by Glynn's husband James and disqualified him from holding a licence for five years. The TC took account of prohibitions Issued, a poor annual test record, unauthorised use, evasion of vehicle excise duty and the use of kerosene in one vehicle.

Barry Prior, for both the company and Simpson, said that matters had come to light that meant he could not represent either party. He asked for an adjournment so that both parties could obtain separate legal representation. Glynn would give an undertak ing that her husband would have nothing to do with the business. The IC said that because of the history, and the seriousness of the allegations by VOSA, she felt that the hearing should continue.

Vehicle examiner Carl Hilton said that during a spot check he inspected two vehicles, issuing one immediate prohibition. Six vehicles were being operated that were not specified on the licence.

Traffic examiner Joanne Henharen said she had observed an overloaded vehicle at a landfill site. There was no 0-licence disc displayed in the window and the driver said he was employed by JH Glynn Haulage. While looking at a copy of the waste transfer note, she noticed that another vehicle had been overloaded and the customer was noted as JH Glynn. Further investigation revealed that St Helens Skip held an interim licence, that both vehicles were registered to that company after previously being registered to JH Wynn, and that neither were specified on the licence.

The Slmpsons indicated that they would prefer lobe legally represented and the It adjourned the proceedings until September. Bell indicated that she wished to examine the relationship between the company, James Wynn and Simpson, and required all vehicles to be put through fresh MoTs.
