• South Wales Licensing Authority John Mervyn Pugh has refused an 0-licence application from Brecon farmer Gareth Morgan because the operating centre was unsuitable.
Morgan had applied for a new restricted licence for one 7.5-tonner to be based in a field at Llanfair Bridge, Brecon.
Powys County Council lodged an objection a day late which was held to be invalid.
Pugh did not consider the council's explanation amounted to "exceptional circumstances".
Morgan said that the field had been used for hired vehicles of a similar size. He was seeking a licence as he had been told by the police that he should apply for one. He felt the site was suitable as adjoining landowners used their fields in a similar way. It would only be used at off-peak times on a seasonal basis. He agreed that he did not propose to house the vehicle in a shed or garage and that he had not applied for planning permission.
Refusing a licence, Pugh said that Morgan must not use the site or operate any vehicle in excess of 3.5 tonnes.
Morgan indicated his intention to appeal to the Transport Tribunal.
