A Cardiff Industrial Tribunal was told Joseph Shaw worked for the John Raymond subsidiary for 17 years. He was sacked without warning in February last year after being off work for three days.

Managing director John Raymond said a multi-millionpound contract for the supply of semi-trailers to the Rockwool company was jeopardised during Shaw's absence. Shaw said he told Raymond a few days before his dismissal that he was having back trouble—and if it was not better he would not be in on the following Monday. He had not considered telephoning in as he thought the company would know the reason for his absence. When he returned to work he was sacked by directors Andrew and Jonathan Raymond.

Ruling that Shaw was unfairly dismissed, the Tribunal said the procedure adopted fell very much below a reasonable standard of behaviour.

However, as Shaw had not telephoned the company they reduced the amount of compensation they would otherwise have awarded by 10% on grounds of contributory fault.
