Hire Matter: Environmental regulations Hearing: Bolton Magistrates' Court Area: North Western A GREATER Manchester skip hire firm and its owner have been ordered to pay £10,500, after being prosecuted in a case relating to fly tipping at a site in Bolton.
In a case brought by the Environment Agency (EA), Bolton Magistrates' Court was told how an investigation into Radcliffebased Abbey Skip Hire and its owner John Lally started in January 2012, when officers from Bolton Council became aware of fly tipping taking place at a councilowned area in Raikes Clough.
Abbey Skip Hire — authorised for three vehicles — tipped waste at a firm based in the area, believed to be responsible for the subsequent fly tipping. However, Abbey Skip Hire failed to complete and sign waste transfer notes as legally required.
The EA accepted that it couldn't be shown that Abbey Skip Hire was responsible for the fly tipping, but maintained that its failure to exercise the proper controls had contributed to the subsequent illegal tipping of the waste.
Abbey Skip Hire said it had now changed its procedures to ensure the required documentation was completed on each transfer of waste. It pleaded guilty to breaching environmental permitting regulations at its site, while Lally pleaded guilty to being responsible for the company's failure to complete and sign waste transfer notes. The firm was ordered to pay £5,000 and Lally £5,500.
Summing up Abbey Skip Hire failed to exercise the proper controls over the waste it collectec4 and these failures helped those responsible for the fly tipping offences to evade justice.
