alWilton Contracts has lost

its appeal revocation of its Operator's Licence, but has been allowed to appeal against its indefinite disqualification from holding one by the Transport Tribunal.

The Tribunal also rejected an appeal against the disqualification imposed on directors Anthony McCarthy and Margaret Reynolds.

The revocation and disqualification orders were made by the South Eastern 8i, Metropolitan Traffic Commissioner Christopher Heaps.

Wilton Contracts, which held a licence for eight vehicles and one trailer, was appearing at its fifth public inquiry since March 1996.

For the company, Jim Duckworth pointed out that in giving his decision the TC made no disqualification order against the company—mention of it only appeared for the first time in the letter from the Traffic Area confirming the TC's decision.

The Tribunal said that although it was to be noted that the TC's oral decision made no reference to disqualification of the company itself, disqualification of both the directors and company was mentioned in the TC's manuscript notes supplied to them.

Since their disqualification were the only matters mentioned on the last page of the TC's notes, the Tribunal accepted that the TC must have changed his mind about disqualifying the company.
