• An application by D. E. Hines (Transport). Ltd., Birmingham, to delete a 24--ton flat trailer from its B licence and add a 5-ton low-loader or flat, was adjourned by Mr. J. Else, the West Midland L.A. in Birmingham last week because a vital witness was not present. The LA said that he could not continue with the case without the presence of a spokesman for Eaton, Yale and Towne Ltd., which provides work for both the applicant company and the objector, Overland Contracts Ltd.
Mr. R. W. Hines, a director of Hines Transport, said that his company had carried for Eaton, Yale and Towne since January 1969 but always through General Navigation Commerce Ltd. Five low-loaders had been employed in this work and two of these still belonged to General Navigation, having been made specially for carrying hardware, fork-lift trucks and tractor shells.
A letter from Eaton, Yale and Towne was presented in support of the application. Mr. D. E. Skelding, for the applicant company, said that it made the point that the granting of another low-loader to Hines would not cause the transferring of work away from Overland Contracts.
Mr. M. J. Carless, for the objector, said that it was understood by Overland Contracts that they were the main operators for Eaton, Yale and Towne. If Hines was granted this low-loader on B licence it would be the start of a whole new venture as all the other low-loaders were on A licence.
At this point Mr. Else said that he would not be able to pass judgment without hearing what the company employing Hines and Overland Contracts had to say. The application was adjourned to be heard in conjunction with an A licence application which Hines has made.
