A WASTE disposal operator whose licence was revoked when he failed to attend a disciplinary inquiry has won it back at a fresh hearing.

North West Deputy Traffic Commissioner Patrick Mulvenna replaced the revocation order against Manchester-based Cloc Services with a formal warning and directed that a fresh maintenance investigation be carried out without warning.

The DTC said he had revoked the licence because there was evidence that the company had failed to co-operate with the Vehicle Inspectorate and had failed to answer letters from the Traffic Area Office. However, since the last occasion information had been received that the principle partner, Carl Stock dale, had been on holiday at the time and had been unaware of the original date of the hearing so it had been reconvened.

After Stockdale said that their three-vehicle restricted licence was the only way that they could run the business, the DTC commented that the firm did not seem to be treating it as seriously as it should.

Stockdale said he realised that he had to get on top of the paperwork. He had been unaware of a vehicle examiner going to their previous premises as nobody had contacted him about it. He could not explain why the company had failed to answer Traffic Area letters and had "misunderstood things a bit".

Issuing the warning, the DTC said that large goods vehicles, when not properly maintained, killed and maimed people.

However, only a delayed prohibition had been issued and it would be disproportionate to take action against the licence that would affect the firm's commercial viability.
