Which of the following most accurately describes the problem?

A CCORDING to the magistrates at ri Doncaster, S.R. and 0., 1941, No. 291, does not alter the definition of a heavy motor car under Section 2 of the Road Traffic Act, 1930, and the driver of a vehicle weighing more than 2-1tons unladen requires a heavy goods vehicle driver's licence. They recently convicted a man for driving a vehicle weighing 2 tons 12 cwt. without having such a licence and his employer for aiding and abetting., The defence was that goods vehicles weighing up to 3 tons unladen were in the motor car class and that, in any event, the need for holding a heavy goods vehicle driver's licence had been waived by the Emergency Powers (Road Vehicles and Drivers) Order, S.R. and 0. No. 1055, which had not yet been revoked.

Mr. G. W. Irwin, secretary of the Eastern Area of the Road Haulage Association, understands that the question of an appeal is being considered.
