The tribunal said that Allen had been employed by Atkinson from August 1986. On 10 May 1991 he received a letter terminating his employment. That letter did not say that his dismissal was on the grounds of redundancy but it was clear from Allen's evidence that it was, as four of the firm's eight drivers were dismissed at the same time.

In its written reply to Allen's claim, the company had claimed that his dismissal was in connection with a road traffic accident. The tribunal rejected that allegation because of a letter from the police informing Allen that no proceedings were anticipated against him.
