Appearing at Wrexham Magistrate's Court, John Riley of Layton pleaded guilty to driving more than 41/2 hours without taking the required breaks. The magistrates were told that a 44-tonne artic loaded with cheese. belonging to Lancaster-based HMT Shipping and driven by Riley, had been stopped in a check at Ewloe, north Wales, on 27 June. The vehicle had been en route from Holyhead to Oswestry.

An analysis of the tachograph charts produced by Riley showed that on 25 June he had driven for 7hr 55min with a break of only 25min and that on the following day he had driven for 7hr 50min with only two breaks of 15min. Asked why he had taken insufficient breaks, Riley had blamed the weather conditions.

The magistrates fined Riley £200 for the first offence and £300 for the second, with £119 costs.
