Which of the following most accurately describes the problem?

• R Ward & Sons of Lowton near Manchester has been banned from running trucks over 12.5 tonnes after a resident complained that its vehicles were constantly mounting the kerb.

The firm was seeking to renew its licence at a Manchester disciplinary inquiry before North Western Licensing Authority Martin Albu.

Albu said that when Ward's licence was last renewed, the company had said that its trucks would not mount pavements in the access road to its site without good cause.

Partner David Ward said the access was down a long alleyway and the only reason vehicles mounted the pavement was if the entrance was obstructed by parked cars.

But neighbour Michael Quirk said he had seen trucks mount the kerb on three occasions when there were no cars parked. His house and garden wall had been damaged.

Albu said that the operating centre was unsuitable for vehicles over 12.5 tonnes. He admitted that access to the site was "not brilliant" but Ward seemed to have existing user rights. Albu adjourned consideration of the renewal application after hearing about prohibition notices on Ward trucks.
