Maddox had applied to renew his national licence for three vehicles and two trailers based at Garswood Station goods yard, Ashton in Makerfield, but four local residents complained about being disturbed by vehicles leaving in the early hours and returning late at night.

Evidence was given that Maddox was not the only operator on the site. His vehicles did not leave early or return late, being primarily engaged on work on motorway sites. He had operated from the site for many years and there was only one occasion when any of the residents had been disturbed by his vehicle.
