AN OPERATOR convicted of not having an 0-licence had delegated the task of applying for one to a mechanic. But no application was made and the vehicle was subsequently impounded.

South Ockenden-based John Saunders has now lost his bid for the vehicle's return.

A traffic examiner told South Eastern 84 Metro politan Traffic Commissioner Christopher Heaps that when the 10-tonne vehicle had been stopped in January it was not displaying an 0-licence identity disc and the driver said he was employed by Saunders In his application for the vehicle's return Saunders said he had filled out an application for an 0-licence and left it to his mechanic to complete but lie never finished it. Since his vehicle wasstopped in January he had submitted a licence application.

Refusing to return the vehicle,theTC said Saunders had admitted he had filled out an application for an 0licence but that it was never finished by the person to whom he had delegated the task.That admission demonstrated his knowledge of the 0-licensing system.

He had continued to operate before the application had been granted and before it was submitted. This showed he knew the vehicle was being operated without a licence or had shut his eyes to the obvious.
