Which of the following most accurately describes the problem?

A French haulier has been jailed for 18 months at Chelmsford Crown Court following a fatal accident involving one of his drivers.

Francois Theron, a partner in and transport manager of Lincs-based Euroreefer & UK International Refrigerated Transport, was found guilty of breaches of the Health & Safety regulations, forgery

and tachograph offences after a trial tasting four-anda-half weeks.

The jury heard how Euroreefer driver John Jaggs died in a crash on the M11 motorway in March 1998 after his truck ran on to the hard shoulder and collided with a French vehicle which had stopped while a wheel was changed. The prosecution alleged that Theron had encouraged the firm's drivers to drive excessive hours on a regular basis, and that he had used various ploys to falsify their tachograph records.

It was also suggested that such practices had been the cause of the accident in that Jaggs probably fell asleep at the wheel.
