• Operators using remote transport managers employed by Weston-super-Mare-based Trans Consult have been dealt another blow. North Western Traffic Commissioner Beverley Bell refuses to sanction the transport manager arrangements between operators and the Somerset firm. Any operator in her traffic area using Trans Consult will now face a public inquiry.

Trans Consult has already fallen foul of North Eastern TC Tom Macartney (CM 18-24 July) and Eastern TC Geoffrey Simms ( CM4-10 July).

Bell spoke out following licence bids from Adrian Pennells, trading as Pennells Haulage, of Derby, and David Pardoe, trading as Pardoe Transport Services. of Congieton. They both had nominated transport managers arranged by Trans Consult.

Bell said the arrangements with Trans Consult might not comply with the provisions of the act: Paul Carless, appearing for both hauliers, had conceded that their present arrangements did not meet the requirements.

The TC said she was not impressed with what she had seen so far with the agency.

Both hauliers undertook to attend a new operator's seminar and to notify the TC within 28 days who they wanted to employ as their transport managers.

However, Trans Consult has hit back over the TC's remarks, stressing that it believes all its arrangements are 100% legal. Proprietor Alec Hayden says: "We are a management services company and all the CPC holders who are involved with us are very good. "They aren't just Irresponsible lorry drivers who are chucking their CPCS around," he adds. "The Traffic Areas Can't see the wood for the trees and are quoting eight-year-old legislation at us."

Adjourning the proceedings and extending the firms' interim licences, initially for six months, the TC said that she thought they would both take the CPC examination themselves.

If they wanted to employ a transport manager she would need to be satisfied that they complied with the Act and that the person concerned had continuous and effective control.

However, Bell held that the repute of the nominated transport managers was intact.
