• Blue Circle's successful appeal against the refusal of 18 permits could undermine the London Lorry Ban, the London Boroughs Transport Committee will be told tomorrow.

The cement company won its appeal against the mandatory fitting of air brake silencers to 18 Leyland Daf vehicles under condition 11 of the London Lorry Ban (CM 21-27 September).

A report by the head of the Lorry Control Unit and its legal adviser says that the Independent Appeals Advisory Committee's decision has "serious implications" for the ban. 0 Last week 12 drivers pleaded guilty at Highbury Corner Magistrates Court to contravening the Ban. They were each fined 275 with 240 costs. At Stratford Magistrates Court on 5 October a driver was fined 275 with 240 costs, and three who did not appear were fined between 2150 and 2200 with 240 costs.

Road Haulage Association director-general Bryan Colley is not optimistic about the prospects of winning the Judicial Review of the ban. He says: "In the event of our losing, the Department of Transport will have to consider its position." Local authorities will be able to override all Construction & Use regulations, he claims.
