• Thomas Johnston, of Bathgate, appeared at Edinburgh last week to show cause and admitted an overloading conviction involving an excess of 2 tons 2 cwt in March and receipt of two immediate prohibitions in July and November and three delayed. These were not disputed and Mr Johnston said that, following receipt of the immediates, his firm had dismissed their then mechanic. They also admitted failure to keep proper records of inspection on the grounds that they did not realize that such records were necessary. The firm trades as an agricultural merchant and haulier and was now operating on a weekly inspection basis and an in-depth inspection every four weeks or 4000 miles.

For the DoE it was shown that the vehicles were in poor condition, that inspections had not been recorded, if carried out, and that there was no regular mechanic at work. It was admitted that it was extremely difficult to obtain good mechanics for this work in the Bathgate area. The LA, Mr A. B. Birnie, said that he could not let the firm off despite these explanations. He would curtail by reducing the licence first to six vehicles and three trailers and then curtail by two vehicles for the months of May and June.
