Which of the following most accurately describes the problem?

• A Nottinghamshire operator's undertakings to abide by the conditions attached to his planning consent led to his gaining licence authority for a new operating centre.

Anthony Tyler, trading as A&H Transport, had held a licence for 19 vehicles and 20 trailers based at Long Eaton. He wanted to reduce the fleet to nine vehicles and 10 trailers, with an operating centre at Belle Vue Lane, Blidworth. The application was opposed by Newark and Sherwood District Council.

Residents, whose represent.tions were not received in time, claimed that the application was not advertised in three local papers circulating in the area, but Eastern Licensing Authority John Mervyn Pugh said the Nottingham Evening News, in which the application was advertised, could be regarded as a "local paper" in that it was the county paper circulating in the area, available to anyone who wanted it.

Carol Wright, chairman of the governors of the local school, said they were concerned about the safety of schoolchildren. The district council said it would withdraw its objection after Tyler consented to certain of the planning conditions, including a reduction in the number of vehicles, being imposed on the licence.

For Tyler, Ian Rothera said the proposed operating centre is next to a colliery and hundreds of vehicles use the road daily.

Granting the application for five vehicles and seven trailers only, Pugh imposed conditions that no authorised vehicles reverse into Belle Vue Lane and that all movements of authorised vehicles take place within the area around the premises so that they never reverse out of operating centre.

He restricted maintenance work to 8.30am to 10.30pm on Mondays to Fridays.

He said there should be no outside storage of goods and materials and that burning should take place on the site.

And he ordered that authorised vehicles shall not enter or leave the premises between 7pm and 7.30am, between 8.15am and 9.15am, and between 3.30pm and 4.30pm.
