A MIDLANDS haulier which claimed to be unaware it had no transport manager for five months has had its licence suspended for 48 hours. But it can choose on which days in January to lay up its fleet.

The ruling on the six-vehicle licence held by Nuneaton, Warwicks-based Chip Chop was made by West Midland Deputy Traffic Commissioner Lester Maddrell at a Birmingham disciplinary inquiry.

The DTC was told the company's maintenance arrangements did not meet the required standard and that a prohibition notice had been issued. Howeve its first-time pass rate at annual test was 100%.

Director James Morley said the company ha, been dealing in potato products but had now move, into general haulage. He did not know the previou transport manager had resigned in July 2004 until tol by the Traffic Area Office in December 2004. He ha relied on a manager to ensure the business was run i a satisfactory manner.

Arrangements had now been made for nel maintenance contractors, inspection sheets were ser to the company promptly and there was a wallchai planning maintenance in advance. Morley had passe his CPC in April 2005 and another employee woul also be nominated as transport manager.

The DTC said the licence was saved by the fact thi apart from a single prohibition there was no evidenc that the vehicles were in an unroadworthy state. If th condition of the vehicles had been bad, the licenc would have been revoked.
