A TRI.ICK DRIVER accused of working for another firm while off sick has been awarded 0,509 for unfair dismissal following doubts over whether a private investigator had identified the right man.

Angel Springs Holdings of Staffordshire employs dozens of drivers delivering water coolers. It engaged a private detective to check up on driver Roger Tomlinson after he went off sick.

A Birmingham employment tribunal heard thatTomlinson had been employed by the Ettingshailbased firm for eight years and had injured his back in a collision.

The investigator told the firm he had seen a man he believed to he Tomlinson leaving his home each day in a truck. Tomlinson was sacked when he returned to work at Angel Springs.

However, he denied he had been working for another firm and said the investigator had mistaken him for his friend Delroy Dunkley, with whom he shared accommodation.

Tribunal chairman David Kearsley said the firm had not done enough to confirm Tomlinson's identity.
