Miss B. J. de Livers, an MoT assistant secretary, says in the written decision that the Minister agreed with the general conclusions of the Inspector, Mr. G. M. Williams, who heard the appeal on September 19, that the rate on return of capital sought by West Yorkshire was not unreasonable or at variance with the Government's prices and incomes policy.

She said the Minister had noted the Commissioners' intention to review the situation after a year, in particular to study the effects of the new drivers' hours provisions and bus grants scheme.

The appellants had claimed that bus grants should be taken into account in the depreciation provision to offset the amount of additional operating revenue required. Miss de Livers said the Inspector agreed that this would "dissipate" the grant in reduced fares and he added that to use the grant in any way other than to meet the "extra cost of accelerated replacement for o-m-o or the extra cost of buses of higher standard would defeat the purposes of the scheme, and involve a quite improper use of the money."

The Minister considers the main object of the scheme is the more rapid replacement of an existing fleet with better vehicles. says Miss de Livers_ "The company's profit and loss account should reflect the benefit it is receiving on the one hand from the new bus grant by way of a reduced depreciation provision", noted the Minister, "and on the other hand any increased charge which may flow from the more rapid replacement of the existing fleet."

The Minister said that because the grant scheme is limited to seven years it may be relevant to decide on the amount of reserves necessary to meet the difference between the cost of new buses, net of grant, within the grant period and the gross cost of replacement vehicles thereafter.
