A CARDIFF industrial tribunal has rejected a claim for unfair dismissal by a driver sacked by Erex Distributors Ltd after he had refused to take his vehicle to have its tachograph repaired.

The tribunal was told that Richard Williams had reported a fault on the tachograph of his vehicle. The following day he found his vehicle loaded for a delivery in Rhondda, with a note telling him to take it to a garage for repair at 1330 hours.

Williams returned to the depot, having completed the delivery, at 1030 hours. He told the company that he was not prepared to hang around.

Williams was told that he was paid for 10 hours a day. When he repeated he was not prepared to hang around, he was told he would not be paid, Wil liams said fair enough, and left the premises. The firm was left with a vehicle that needed urgent repairs to its tachograph.

When asked for an explanation by the manag ing director the next day, Williams was unable to give any and he was instantly dismissed.

The tribunal concluded that the company had acted reasonably. It said that any employee had a duty to carry out reason able instructions. Mem bers could see nothing that suggested taking a vehicle to a garage, even if

it meant hanging around for 21/2 hours, was in any

way unreasonable; it had been a perfectly reasonable and sensible instruction.
