Which of the following most accurately describes the problem?

• Though granting a licence application by the son of a Portsmouth haulier, the new South Eastern Licensing Authority Brigadier Michael Turner has imposed severe environmental conditions on the licence in the light of representations from local residents.

Terence Woodford had applied for a licence for one vehicle in possession, with one to be acquired, based at New Road, Clanfield. He was formerly in partnership with his father with a licence for six vehicles based at Twyford Avenue, Portsmouth.

Those premises were the subject of a compulsory purchase order and Woodford's father decided to retire.

Evidence was given by Woodford that he had been unable to find an operating centre close to his home and that he had been forced to take up an offer of help from another haulier R j Harris who held a licence for five vehicles in possession with three to be acquired from the Clan field premises.

Brigadier Turner said he felt that the application would result in a material change. He was faced with a delicate balancing act between the quite proper wish of Mr Woodford to operate a business and the equally proper wish of local residents to have freedom to enjoy the use of their property.

On balance he felt that the additional environmental problems that would be caused by the introduction of an additional small rigid vehicle at the site were in sufficient to justify outright reftisal. However he had to restrict the unsocial aspects of the operation by imposing some necessary severe conditions.

These included that not more than one authorised vehicle may be kept at the operating centre, and that the vehicle must be a two axle rigid not exceeding 16 tonnes gross.
