Dismissing the application, the Tribunal said that Mr Garside had clearly disobeyed an order within the terms of his Contract of Employment.
It was quite wrong for him to consider he had the right to decide what he would or would not do.
They were satisfied he was verbally warned that if his conduct did not improve he was likely to be dismissed, the Northampton refusal being the straw which broke the camel's back. It was gross misconduct justifying summary dismissal without warning.
