the magistrate that all periods of work, including overtime, must be recorded on tachograph charts. Drivers must keep full records of driving, other work, breaks and rest. Non-driving overtime or other work will not count as rest, even if the driver is free to choose whether to work or not.
• In the High Court, the ruling against Dover Harbour Board acting unlawfully in refusing to take animals destined for slaughter, opens doors for livestock hauliers to bring claims for compensatory damages against the ports which ban livestock.
• Since 23 January 1995 carriers of livestock have been required to complete in advance of the journey a plan or animal transport certificate and submit to the MAFF.
• A Divisional Court has found that English courts have no power to convict for tachograph offences committed abroad. A driver from Northern Ireland was stopped in England. His charts were examined and offences committed in France were disclosed. The magistrates acquitted the driver and the Appeal Court said they were correct.
• EU proposed changes to dangerous goods regs: A directive was adopted by the Council in November which requires member states to implement national dangerous goods rules in line with ADR by 1 January 1997.
