Which of the following most accurately describes the problem?

• The position of the nominated transport manager on the licence held by Shropshire haulier Victor Harding is to be investigated by a traffic examiner, on the direction of West Midland Deputy Licensing Authority Roger Seymour.

Harding, who holds a national licence for two vehicles, failed to appear at disciplinary proceedings in Birmingham — 'but the inquiry was attended by members of the public and Bridgnorth District Council, who were concerned about what they claimed was the unauthorised use of Forest Glade, Bewdley as an operating centre.

Seymour said there was no evidence that Harding had a full-time transport manager. He understood that Harding also carried on business restoring and trading in vehicles, but if those vehicles were kept at Forest Glade they were outside his jurisdiction.

Local residents gave evidence that they had seen licensed vehicles parked at Forest Glade.

Seymour warned that if Harding did not have a qualified transport manager he would revoke the licence. If there was a qualified transport manager, the hearing would be resumed on the grounds that Harding was using vehicles outside the terms of his licence.
