• A driver sacked by Cardiffbased drapery company Peacocks Store for allegedly taking excessive breaks has been awarded almost £12,000 compensation for unfair dismissal.

A Cardiff industrial tribunal was told that Peter Pentecost of Whitchurch was sacked after new driving schedules were introduced. Pentecost claimed that the new schedules were unworkable. He said he had been no worse than any of the other drivers and had been singled out.

Ordering the company to pay Pentecost £11,961, the tribunal said that an analysis compiled by Peacock did not show conclusively that he was worse than the others. The new schedules were not easy to interpret and were difficult to apply.

The tribunal found it extraordinary that the first time Pentecost's performance under the new schedules was discussed with him was at a disciplinary interview, and decided that Peacock had acted unreasonably by giving drivers a "first and final warning".
