driving a heavy lorry in the outside lane of a motorway. I had swerved into the outer lane to avoid an accident but I was seen by the police. I explained to the magistrate why I was in the wrong lane but it made no difference. I have seen another case reported of a vehicle being in the outside lane and the driver was fined only £5. Why is there a difference between one fine and another?
Magistrates are governed by the Road A Traffic Acts to maximum penalties for specific offences. They must not, of course, exceed the maximum penalty but are free to use their discretion, depending on how seriously they view the offence committed, in imposing the punishment they see fit.
