Which of the following most accurately describes the problem?

• North Eastern Deputy Licensing Authority Anthony Richardson has refused an application from Wimpey Waste Management for licence authority to transfer vehicles from Woodkirk, near Leeds, to a depot located at Dewsbury.

Wimpey wanted to transfer 17 vehicles with licence authority for 25 at Dewsbury. There were nine environmental representations from neighbouring residents and the DLA reserved decision following a public inquiry in Leeds.

Holding that the Dewsbury depot was unsuitable on environmental grounds, Richardson said there were numerous houses close to the site and the problem was one of noise disturbing local residents. It was clear that the company did its best to meet the reasonable anxieties of neighbouring residents, but he could not see how Wimpey could avoid noise that would be very disturbing to the residents.

There would be a much greater number of vehicles at the Dewsbury depot and it was essential for Wimpey's work that some vehicles left at about 06:45hrs, with the rest following at about 07:15 or 07:30hrs.

The situation could not be remedied by imposing conditions, since Wimpey's intentions would be completely frustrated by a condition against starting so early or which substantially reduced the number of vehicles.
