Which of the following most accurately describes the problem?

• A director of Witney, Oxonbased Zedcor has expressed doubts about the results of a check on one of the firm's vehicles at the Boston Spa dynamic axle weigher, but the company and driver has still been convicted of overloading by the Wetherby Magistrates.

Zedcor and Eric Cruickshank had denied overloading the first axle of a two-axled rigid on 16 March 1989.

Traffic examiner Tracey Caplin gave evidence that the axle had weighed 3,310kg, an overload of 210kg (6-7%). She said the vehicle had initially been driven too fast over the weighbeam and had to go round again. On both occasions the first axle came out at 3,310kg.

West Yorkshire trading standards officer David Bailey said the dynamic weighbridge was checked in February and May.

Cruickshank maintained that the first axle weight had been greater when the vehicle was reweigheci.

The magistrates fined the company 240 and Cruickshank 220, with 244 costs apiece.
