Which of the following most accurately describes the problem?

• A haulage firm, whose managing director was banned from holding an Operator's Licence, has been granted a new licence after his wife announced that she is to run it.

Walsall-based Transline Logistics previously had its licence revoked after managing director Anthony Shaw admitted sending vehicles to the Continent on six occasions, even though the company only held a national licence (CM 5-11Nov 1998).

A traffic examiner had denied Shaw's assertion that they had discussed his plans to use another operator's 0-licence. As well as revoking the licence, West Midlands Traffic Commissioner David Dixon disqualified Shaw from holding or obtaining an 0-licence for 12 months.

Transline was seeking an international licence for 12 vehicles and three trailers. The IC heard that the directors were now Shaw's wife Janet and daughter Kelly, and that the transport manager was a Lorraine Green. Anthony Shaw was employed as a driver Granting the licence, Dixon said that he did so on the understanding that Anthony Shaw would have no Involvement in the running of the business.

Last year Commercial Motor revealed that Shaw's previous company, JS Express, was carrying out UK haulage for TNT Retail Express without an 0-licence.

It was using four 7.5-tonners and Shaw insisted he was operating legally under someone's else's licence. He was later granted a licence for the vehicles run by Transline Logistics.
