A fifth of drivers stopped by Vosa are in breach of drivers' hours rules, Vosa executive director of next generation testing Alex Fiddes told the Transport Law & Compliance seminar. A 'tired driver' remained the biggest risk to an operator, said Fiddes. "A driver who chooses not to comply with the rules and regulations of the road is your weakest link," he said.

Nick Denton, traffic commissioner for the South East, said it isn't enough for a transport manager to simply tell drivers to stick to the rules. "You have to check and analyse drivers' tachograph records, and discipline them if they aren't abiding by the rules," he said.

Meanwhile, Vosa said authorised testing facilities (ATFs) have helped to improve first-time pass rates of LGVs. For the year to 31 March, the first-time pass rate rose by 2.3% to 77.6% for all LGVs.

"The industry has invested in equipment and facilities and vehicles are being better prepared," said Fiddes.

More than 70% of tests are carried out at ATFs, a number that Vosa expects to hit 85% by April.
