Which of the following most accurately describes the problem?

• Patrick Gilooly Ltd of Airdrie had its licence curtailed by two vehicles for two months at Glasgow last week in a case which involved the inspection of vehicles on subsequent days. Mr F. Wetherell, the area Mechanical Engineer, said that on August 2 six vehicles were inspected, by arrangement, and one immediate and two delayed GV9s were imposed. Two vehicles which had been inspected but had not been given prohibitions were then stopped the next day at a roadside check in Fife and each given an immediate GV9.

The company argued that the lack of prohibitions on August 2 justified the use of the two vehicles on August 3 and the subsequent GV9s seemed contrary to the first lack of prohibitions.

The Scottish LA, Mr A. B. Birnie, agreed that in such circumstances an operator should feel free to use a vehicle and he found it difficult to blame Gilooly. However, the firm did have four overloading convictions and it was clear that the vehicle examiners did not have a high opinion of the operator. In curtailing two vehicles the LA made it clear that he was taking a lenient view of the matter.
