THE Transport Tribunal last week upheld the Scottish deputy LA's decision when it rejected an appeal by J. S. Lyon of Banchory, who had sought to switch a Contract A licence to open A licence.

At a public inquiry the appellant had told the LA that since he had entered its Contract A with Timbuyers Ltd. of Aberdeen two years ago the nature of the work had changed. The change had resulted in less profitable back loading and more longdistance running.

Mr. C. MacCrae, general manager, Timbuyers, who supported the application at the public inquiry told the LA that he was receiving satisfactory service at an economic rate.

Appearing for the appellant, Mr. M. Mulligan told the Tribunal that it appeared as if one had to be losing money or making a minimal profit before a grant was made.

The Tribunal had access to the appellant's accounts and it agreed with the LA that the firm was making sufficient profit to enable it to carry on business under existing conditions.
