Which of the following most accurately describes the problem?

THE Metropolitan LA, Mr. D. I. R. Muir, on Tuesday granted an application by Bulk Storage Ltd., of Walthamstow, to add seven tractive units and an equal number of trailers to its B-licensed fleet.

The unusually complicated inquiry began with an application by H. Sharpe and Sons (Aveley) Ltd„ of West Thurrock, Essex, to add a 4-tonner to its general goods licence, and leave to renew a B licence for seven vehicles with the conditions: "Goods for import and export only on .behalf of Seabourne Pan-European Transport Services and Hatter Shipping Services Ltd."

The LA said these applications had been withdrawn but he had not accepted the withdrawal; he was seeking information on the work, if any, that the vehicles were doing and their whereabouts.

Mr. M. H. Jackson-Lipkin, representing Bulk Storage, then introduced Mr. J. R. Templeton, until recently a senior executive of Hatter Shipping and now operations manager of Pennant Transport International, a Bulk Storage subsidiary.

Mr. Templeton said only seven vehicles were operational on any Sharpe licence since December 1966; neither had it taken up the LA's permission to acquire a considerable number of vehicles.

Mr. K. S. Morris, of Aveley, said Hatter Shipping had been in voluntary liquidation since October 6 last, after the application for the transfer of licences had been made. A subsidiary, Hatter Bulk Transport, was still operating.

The LA said he would give his decision only after hearing the remaining applications. An application by Hatter Shipping to renew a B licence for one vehicle was dismissed for lack of prosecution.

Mr. Jackson-Lipkin then presented the application by Bulk Storage conditioned: "Goods for import and export via Continental road services and towing of Continental trailers, Great Britain." Objectors were Transport Holding Co. (BRS), represented by Mr. K. Schiemann; and Crow Carrying Co. Ltd., represented by Mr. A. Carlisle.

Mr. Schiemann said both objectors' concern was largely at the possibility of a dual grant in respect of the work done previously by Sharpe.

At that point the LA said that if he were satisfied that Bulk Storage had the facilities and the customers either from Sharpe or Hatter, he would use his powers under Section 177 to remove vehicles from Sharpe, equivalent to those applied for by Bulk Storage.

When called by Mr. Jackson-Lipkin, Mr. Templeton said Pennant would operate the vehicles if a grant were made and all the Hatter customers would transfer their business to it. A similar service would be offered.

He told the LA that Bulk Storage had seven short-term licences due to expire-on the following day and that it had purchased three new vehicles with four more on a re-purchase hire agreement. Seven tanker and TIR trailers were also on order.

Owing to docks difficulties, Mr. JacksonLipkin was unable to provide oral witness other than Mr. L. R. Scott, transport manager, Bulk Storage, who produced customers' letters of intent. He added that his company had acquired Hatter's warehouse and was building a large new depot.

Answering Mr. Schiemann, Mr. Scott said that Shape was no longer trading and only Hatter was in voluntary liquidation. Recalled once again, Mr. Templeton said that operations had been carried out by Sharpe tractive units with Hatter trailers, on Sharpe licences; it was Hatter who accepted the customers' money.

The LA decided that the Sharpe B licence would not be renewed and a grant in 'respect of an A licence would not be made. He would take action under Section 177 against all its vehicles and seven, comparable with those in the Bulk Storage application, would be removed.
