Which of the following most accurately describes the problem?

NICK DENTON, the traffic commissioner (TC) for London and the South East, has revoked the 0-licence of a Queenborough, Kent-based haulier who ceased trading but allowed his stepson to continue to use the licence.

At a December public inquiry in Eastbourne, the TC was told how John Negus stopped working at JN Clearance in December 2011 but then handed over the licence to Darren Harrison to allow existing contracts to continue.

During the hearing, it was revealed that Negus was unable to provide Vosa with any records of routine safety inspections for the vehicle his stepson was operating. He also did not have a system in place for planning these mandatory inspections in advance.

In addition, daily defect checks carried out on vehicles had not been recorded in writing and the number of vehicles that failed their annual test was higher than the national average.

A safety critical prohibition had also been issued to a vehicle with an underinflated tyre, operated under the licence held by Negus.

At the inquiry Denton considered a fresh sole trader licence application from Harrison, trading as JN Clearance. However, he told Harrison he must attend an 0-licence course and present evidence at a further hearing on how he intends to manage the licence before he reaches his final decision. If Harrison fails to satisfy the TC that he has attended the course by 11 February, his application will be refused without another hearing.
